Terms and Conditions of Sales
This webpage and any documents/webpages referred to tells you the terms and conditions upon which we supply Products listed on www.vapourfreaks.co.uk ("our Site") to you.
Please read these terms and conditions carefully before ordering Products and understand that by ordering any of our Products you agree to be bound by these terms and conditions and if you refuse to accept these terms and conditions you will not be able to place your order on our Site.

1) About Us
Vapour Freaks Ltd ("us", "our" or "we") is registered in England and Wales number 11272301. Our registered office is 140 High Street, Smethwick, England, B66 3AP.
2) Nicotine Warning
You must be over 18 in order to purchase vaping products and/or products that contain nicotine. E-liquids should not be used by pregnant women or those intolerant or allergic to Propylene Glycol or Vegetable Glycerine.
Some products include nicotine, which is an addictive drug, therefore if someone has never used nicotine we recommend that they don't start. Nicotine is poisonous if ingested, and products containing it should be keep away from children and pets.
3) Vaping Hardware Warning
Using vaping products is at the user's own risk. Vaping involves the use of liquids, battery cells, heating wire or mesh, electricity and heat and therefore are potentially dangerous if used incorrectly. Users are advised to sufficiently research and/or take advice if inexperienced or unsure of what they are doing. We are not and cannot be liable should anyone use vaping hardware incorrectly.
4) Placing an order
By placing an order on our Site you warrant that you are at least 18 years old and are legally capable of entering into binding contracts.
After you have placed an order you will receive an email from us acknowledging that we have received your order. This does not mean that we have accepted your order. Your order constitutes an offer to contract with us to buy Products. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Products have been despatched.
The contract between us (Contract) will only be formed when we email you the Despatch Confirmation. The Contract is made by you with Vapour Freaks Ltd in relation to the supply of Products.
The Contract will relate only to those Products whose despatch we have confirmed in the Despatch Confirmation email. We will not be obliged to supply any other Products which may have been part of your order until the despatch of such Products has been confirmed in a separate Despatch Confirmation. We reserve the right to refuse any order placed.
Your order will not be processed until correct payment has been received by us.
5) Risk and Title
The ownership of Products will only pass to you when we have received your full payment for the Products and any delivery charge. The Products will be at your risk from the time of delivery to you.
6) Product variations
Products can vary slightly from batch to batch and therefore the actual products you receive may differ from the representative images and descriptive text displayed on our website. Design changes may vary from batch to batch. Product specifications may change from batch to batch.
E-liquid flavours, tastes and VG/PG ratios may also vary from batch to batch, and differ from that which is indicated on our website. Although we try to ensure product information is accurate at the time we list a product, a manufacturer may subsequently change their product. Product variations are not a product fault.
We try to ensure that e-liquid flavours are described inline with the manufacturer's guidance. How an e-liquid is perceived as tasting varies depending on many factors outside the control of the manufacturer. For example, if a manufacturer says a particular e-liquid has doughnut flavouring in it, you may believe that it tastes more of pastry with a particular vape device setup. This is not necessarily a product fault.
Please double-check that the Delivery Address you provide is accurate.
The Delivery Charge will be calculated and shown to you on the CHECKOUT page once you enter a delivery address and before you place an order.
Your order will be processed within 1 to 3 working days of receiving your full payment. We will contact you if exceptional circumstances mean we cannot process your order within 4 days.
If your package cannot be delivered to your provided delivery address because it is not valid or is incorrect, or no one was at the address to sign for the package, or you do not collect your package from their designated depot, or for whatever reason the package cannot be correctly and contractually delivered, then we cannot be held responsible and if the package is not returned to us for whatever reason you cannot ask for a refund or a replacement from us.
If the courier notifies us of a failure to deliver a parcel within a reasonably expected time frame, we will investigate the issue with the courier before considering what action we will take next.
Please contact us if your package hasn't reached you within 14 working days. If the time elapsed between placing your order and you notifying us that you have not yet received it is more than 21 working days, the courier may not be able to track your order and we may not be unable to assist with the lost package.
All orders must be fully inspected upon delivery and any errors reported to us within 48 hours.
In the unlikely event that there is an alleged discrepancy of any kind in your order package you must contact us within 48 HOURS of the delivery. In order for us to investigate any alleged claim please keep all packaging and proof of delivery as we may also request a photograph.
8) Price and Payment
Product prices are displayed in £GBP and exclude VAT and exclude delivery costs.
We may change product prices and delivery charges at any time, but changes will not affect orders where we have already sent you a Despatch Confirmation email.
If a product’s correct price is higher than the price stated on our Site we will contact you for instructions before despatching the Product.
We are under no obligation to provide Products to you at the incorrect (lower) price if the pricing error is obvious or should otherwise have reasonably been recognised by you as a mispricing.
Payment for your order will be charged between the time when you place your order and when the Products are despatched.
9) Our Refunds and Exchanges Policy
Within the EU Consumer Rights Directive, you can return items (bought from www.vapourfreaks.co.uk only) for an exchange to alternative items or return for a refund, as long as you apply using the procedure below WITHIN 14 CALENDAR DAYS of receiving delivery of your items.
We do not deal with returns of products bought elsewhere.
Items for exchange or return must be unused, unopened and in resale-able condition. All returns are subject to a physical inspection.
If you believe an item was faulty when received, you may also request an exchange or ask for a refund. Please do this immediately. Any delay will lessen your chances of a successful defect claim.
Our delivery charges are non-refundable.
You will need to pay the return postage yourself unless the return is a result of OUR error (you received an incorrect or defective item, etc.)
PROCEDURE: Complete our CONTACT FORM and explain why you are requesting a return. We'll then contact you to discuss.
Legal Compliance: This returns and refunds policy is in accordance with the EU Distance Selling Directive which came into force in October 2000 and is part of UK law under the Consumer Protection (Distance Selling) Regulations 2000. This law applies to all transactions within the UK where a consumer does not meet the vendor.
If you are sent the WRONG PRODUCT in error you must contact us as soon as possible no later than 14 calendar days of receipt of the Product to discuss a RETURN AND EXCHANGE.
10) PRODUCT WARRANTY
E-liquids do NOT have a warranty but have an expiry date beyond which they may no longer be suitable to be used. If you believe an e-liquid supplied by us is faulty or out of date when despatched please complete our CONTACT FORM and explain why you are requesting a return. We'll then contact you to discuss.
Vaping hardware is usually covered by a manufacturer warranty and information about it can be found in their packaging. You may contact us or the manufacturer to discuss a product fault. Improper use can invalidate a claim. In many cases, perceived faults are merely incorrect usage. If you have a problem with your vaping hardware, feel free to call us and we will try to assist.
The liability of VAPOUR FREAKS LTD in connection with any Product purchased is strictly limited to the purchase price of that Product.
VAPOUR FREAKS LTD accepts no liability for any loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time or for any indirect or consequential loss or damage of any kind however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable. The foregoing limitations do not apply to any liabilities which may not lawfully be excluded or limited including any liability for death or personal injury resulting from our negligence.
We will not be liable to you where we are unable to fulfil any of our obligations to you as a result of circumstances beyond our control.
12) Law and Jurisdiction
The place of sale for all transactions conducted on this website is England. All Contracts made with us for the purchase of Products will be governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the exclusive jurisdiction of the courts of England.
